§ 2. General
By using the online store and/or making a purchase, the customer accepts these terms and conditions of purchase.
The terms and conditions of purchase apply to consumers and, where applicable, also to business customers. If a provision applies only to a specific category of customers, this is explicitly stated.
For consumer purchases, mandatory Swedish consumer legislation applies. If any provision in these terms and conditions of purchase is contrary to mandatory law, the customer has the rights that follow from such legislation.
In order to make a purchase, the customer must be authorised to enter into a contract under the applicable law and provide accurate and complete information when placing the order.
§ 3. Definitions
- The online shop: the website and e-commerce operated on miniohome.se.
- Customer: a natural or legal person who uses the online store or shops via the online store.
- Consumer: a natural person who is acting primarily for purposes which are outside his trade or profession.
- Business customer: a natural or legal person acting in the course of a business activity.
- Product: product offered for sale in the online shop.
- Order: the customer's order of one or more products via the online shop.
- Agreements: contract of sale that comes into existence when the Seller confirms the order.
- Working day: Monday to Friday, excluding public holidays affecting order processing and logistics.
§ Products and prices
The products in the online shop are presented with the main characteristics as shown on the respective product page.
All prices in the online store are in Swedish Krona (SEK) and include VAT, unless otherwise explicitly stated.
Shipping costs and any other charges are displayed at checkout before the customer finalises their order.
We reserve the right to adjust prices, assortment, promotions, stock status and product information at any time. A price change will not affect an order that has already been confirmed by the Seller.
Discount codes, promotions and other offers cannot be combined unless explicitly stated.
If an obvious typographical or system error has occurred in the price, stock status or product information, we reserve the right to correct the error even after receiving the order. In this case, the customer will be contacted as soon as possible.
§ Order and contract
Once the customer has placed an order, an automatic order confirmation will be sent to the e-mail address provided by the customer. The automatic confirmation means that the order has been received, but does not in itself constitute a final acceptance of the contract unless otherwise stated.
The purchase contract is deemed to have been concluded when the Seller has confirmed the order and started processing or delivering the order.
The seller reserves the right to refuse or cancel an order if:
- the product is no longer in stock,
- the customer has provided incorrect information,
- there is suspicion of fraud or abuse,
- there has been a manifest pricing or systemic error.
If an order cannot be fulfilled in whole or in part, the customer will be informed and any payment made for undeliverable products will be refunded.
§ 6. Payment
Available payment methods are displayed at checkout for each order. Depending on the order and the country, the online shop may offer payment via, for example:
- card payment,
- Klarna,
- PayPal,
- bank transfer,
- other payment methods provided by our payment providers.
Payment is handled by external payment providers. The customer is responsible for complying with the terms and conditions of each payment provider.
As a general rule, refunds are made using the same method of payment as that used at the time of purchase, unless otherwise agreed or there are objective reasons for using another method.
If payment cannot be made or accepted, the Seller is entitled to suspend or cancel the order.
§ 7. Delivery
We currently deliver to the following countries:
- Sweden
- Denmark
- Finland
- Norway
- Estonia
- Latvia
- Lithuania
- Poland
Available delivery options and current shipping costs are displayed at checkout before the order is finalised.
Normal delivery time is usually 10-15 working days, unless otherwise indicated on the product page or at checkout.
If an order contains products with different delivery times, the longest delivery time indicated applies to the entire order, unless otherwise stated.
The delivery time is calculated from the date on which the payment has been authorised or, in the case of payment methods allowing for later payment, from the date on which the order is confirmed and processing can begin.
The Customer is responsible for ensuring that the delivery details are correct and complete. If a shipment cannot be delivered due to incorrect information provided by the Customer, or if the parcel is not collected and therefore returned to the Seller, the Seller is entitled to charge the Customer the actual costs of return shipping, re-shipping and handling.
The risk in respect of the product passes to the consumer when the product has physically come into the possession of the customer or his authorised representative. For business customers, the risk passes upon delivery to the carrier, unless otherwise provided by mandatory law or special agreement.
§ 8. Complaints and defects in goods
If a product is faulty, the consumer has the right to complain under applicable consumer legislation, including the Consumer Sales Act.
The consumer has a right of cancellation in three (3) years from the date of receipt of the goods, provided that the defect is original. Complaints must be made within a reasonable time after the defect was discovered or should have been discovered. Complaints made within two months of the discovery of the defect are always considered to have been made in good time.
Complaints can be made by e-mail to info@miniohome.se.
In order for us to handle the complaint as quickly as possible, the customer should specify:
- order number,
- name and contact details,
- which product the complaint concerns,
- a description of the error,
- please provide pictures showing the error.
If the complaint is accepted, the Seller shall bear the reasonable costs of return freight or other necessary handling.
If the complaint is accepted, the consumer has the right to claim, depending on the situation and what the law allows:
- remedial action,
- re-delivery,
- price reductions,
- cancellation of the purchase,
- or any other penalty provided by law.
The seller is entitled to offer repair or replacement in the first instance if this can be done within a reasonable time and without significant inconvenience to the customer.
Any factory warranty is only valid if explicitly stated for the product or in the accompanying warranty conditions. A warranty does not limit the customer's statutory rights.
§ 9. Right of cancellation
When shopping as a consumer at a distance, the customer is generally entitled to withdraw from the purchase within 14 days without giving any reason.
The withdrawal period is 14 days from the day after the customer, or someone designated by the customer, has received the goods. If the order concerns several goods delivered separately, the period starts from the day after the last good is received.
In order to exercise the right of withdrawal, the Customer shall notify the Seller of his decision to withdraw from the contract within the withdrawal period. The notification can be sent by e-mail to info@miniohome.se.
The customer can use the cancellation form at the bottom of this page, but it is not required.
You can also use our returns form here: Return form Minio Home (PDF).
Once the customer has notified us of their cancellation, the goods must be returned without undue delay and at the latest within 14 days of the date on which the customer notified us of their decision.
Returns for cancelled purchases are sent to: Nowy Bidaczów 29, 23-400 Biłgoraj, Poland.
Unless expressly stated otherwise, the customer bears the direct cost of return shipping when exercising the right of withdrawal.
The customer shall be liable for any loss of value resulting from the fact that the goods have been handled to a greater extent than is necessary to determine their characteristics, function and nature.
The seller will refund the amount paid by the customer for the returned goods, including the standard shipping cost for the original delivery, without undue delay and at the latest within 14 days from the day the seller receives the customer's notice of withdrawal. However, the Seller is entitled to delay the reimbursement until the goods have been returned or until the customer has proved that the goods have been returned, whichever is the earlier.
If the customer has chosen a more expensive delivery method than our cheapest standard option, the additional cost will not be refunded.
§ 10. Exceptions to the right of cancellation
The right of cancellation does not apply to contracts that are excluded by mandatory law. This may include, for example:
- goods made according to the customer's instructions or otherwise clearly personalised,
- goods that can quickly deteriorate or become obsolete,
- sealed goods which, for health or hygiene reasons, cannot be properly returned if the seal is broken,
- digital content delivered by means other than on a physical medium, if the delivery has started with the customer's explicit consent and with confirmation that the right of withdrawal is thereby lost,
- services that are fully completed, if the customer has expressly agreed to the commencement of the service and accepted that the right of withdrawal is lost upon completion of the service.
§ 11. Business customers
For business customers, the consumer protection rules set out in these terms and conditions of purchase, such as the right of cancellation under the Distance and Off-Premises Contracts Act, do not apply.
Unless otherwise agreed, Swedish sales law applies in applicable parts to purchases between the Seller and business customers.
The Seller's liability to a business customer is limited to direct damage and at most to the amount paid by the business customer for the product in question, unless otherwise provided by mandatory law or if the damage was caused intentionally or through gross negligence.
§ Account, newsletter and use of the online shop
The online shop can offer features such as customer account, newsletter and contact form.
Using the online shop, creating an account and subscribing to newsletters is free of charge unless otherwise stated.
The customer is responsible for ensuring that the information provided is accurate and up-to-date.
The Customer may not use the Online Store in a way that violates the law, harms the Seller or third parties, disrupts the functioning of the website or spreads malware, spam or other unauthorised content.
The customer can cancel their account or newsletter subscription at any time by contacting us or using any unsubscribe link in mailings.
The seller has the right to suspend the account or restrict access in case of suspicion of abuse, security risk, breach of law or material breach of these terms and conditions of purchase.
§ 13. Personal data
The seller is the data controller for the processing of personal data in connection with orders, customer service, complaints, returns and other use of the online store, unless otherwise expressly stated.
Personal data is processed in order to:
- administer and deliver orders,
- manage payments, returns and complaints,
- communicate with the customer,
- fulfil legal obligations,
- and, if the customer agrees, send marketing communications.
Personal data may be shared with payment service providers, carriers, IT providers, accounting or advisory partners and other service providers to the extent necessary for the operation of the business and the performance of the contract.
For more information on how personal data is processed, see our privacy policy on the website.
§ Disputes and applicable law
We always endeavour to resolve any questions or disputes directly with the customer in the first instance.
In the event of a dispute, consumers in Sweden can turn to the General Complaints Board (ARN), www.arn.se, for consideration. Customers can also get guidance from the Swedish Consumer Agency and Hallå Konsument.
Swedish law shall apply to these terms and conditions of purchase and to contracts concluded via the online store, without prejudice to the protection afforded to consumers under the mandatory law of their home country within the EU/EEA when such law is applicable.
Any dispute not resolved by mutual agreement or by alternative dispute resolution may be submitted to the jurisdiction of a court of general jurisdiction under mandatory law.
§ Force majeure
The Seller shall not be liable for delays or non-performance due to circumstances beyond our reasonable control, such as war, governmental decisions, labour disputes, widespread operational disruptions, natural disasters, pandemics, transport disruptions or similar circumstances.
If such a situation lasts for a longer period, both the Customer and the Seller are entitled to cancel the contract in the part that cannot be fulfilled, without the right to damages in addition to repayment of the payment made for undelivered goods.
§ 16. Changes to the terms of purchase
The seller reserves the right to update these terms and conditions of purchase as necessary, for example in the event of changes in legislation, regulatory requirements, payment solutions, delivery methods or website functions.
The version of the terms and conditions of purchase in force at the time of the customer's order is the version applicable to the purchase in question.
